1. Agreement Acceptance
Your signature on a rental agreement, or payment, or taking possession of the property, is evidence of your acceptance of this agreement as well as your agreement to abide by all rules regarding guests that are noted in the “Rules and Regulations of the Seven Dwarfs Condominium Association”. This agreement may not be re-assigned by tenant and the tenant may not sublet premises. ALL guests must be included in the rental agreement. The owner will not accept 3rd party reservations. Tenant acknowledges and understands that he/she is subject to “Expedited Eviction” if tenant
Holds over possession after his or her tenancy has expired,
Commits a material breach of this Short Term Rental Agreement,
Fails to pay rent as required by the agreement,
Obtains possession of the property by fraud or misrepresentation.
These conditions and the reservation constitute a contract between the owner of the property and the person who made the reservation. A contract shall only exist once the reservation and the deposit have been received by us, and a confirmation is issued.
Tenants expressly acknowledge and agree that this Agreement is for transient occupancy of the Property, and that Tenants do not intend to make the property a residence or household. Tenant shall use the property for legal purposes only and other use, such as but not limited to, illegal drug use, abuse of any person, harboring fugitives, etc. shall cause termination of this agreement with no refund of rents or deposits. Tenants agree to pay all reasonable costs, attorney's fees and expenses that shall be made or incurred by Landlord enforcing this agreement.
2. Rental Payment
Full payment for rental must be made no later than 30 days prior to arrival date. Acceptable payment methods are; personal check, money order, cashiers check, or Western Union. Payments of rent by PayPal are subject to addtional charge of the PayPal fee. If full payment is not received, your reservation will be cancelled and your deposit will be forfeited.
The home will be made available for new reservations. Obligation for payment of full amount will be applicable. State and Government tax will be charged separately (13% from of July 1, 2004). We DO NOT accept wire transfers or direct bank deposits.
The rental price includes normal use of utilities.
3. Reservation/Security Deposit
Initial reservations can be made by e-mail or telephone, but dates will not be confirmed until after payment of a deposit of US $250.00 has cleared.
Reservation deposits are refundable ONLY as described in section 5 "Cancellation Policy" .
The Reservation deposit converts to a Security Deposit once the payment for the rental is made, additional amounts may be required for longer stays.
This security deposit will be charged to cover extra accommodation costs, loss or damage to the rental property in excess of normal wear and tear during the period of rental.
If the property is not left in a suitable condition, it may be necessary to charge the security deposit for costs to cover extra cleaning.
Guests will be notified within 7 days of any charges. The Tenants and Tenants' Guests are responsible for breakage and repairs to the home and property due to their occupancy.
All damages to the home or property must be reported to the owner at time of incident, for after-hours non-emergencies please report the next morning.
Tenants expressly recognize that any insurance for property damage or loss which the Owner may maintain on the property does not cover the personal property of Tenants, and that Tenants should purchase their own insurance for Tenants and Guests if such coverage is desired.
4. Occupancy
The rental period begins at 4:00 PM on the day of arrival and ends at 11:00 AM on the day of departure. The maximum number of overnight persons permitted in the home is 8. Any number of persons in excess of 8 must vacate the property, and it is an express term of this agreement, that you accept.
Early arrival or late departure times are subject to availability. Additional charges may apply.
Check-in is 4:00 pm. All guests must present their confirmation letter at the complex security gate to gain access. There is a lockbox with the keys at the townhouse door.
After business hours: Please contact us prior to arrival if you will be arriving after 10 pm and we will give you full instructions for after hour’s check-in. Please be aware of others in your group that might be arriving after office hours and will need instructions and access to the rental home. We will be happy to leave check-in instructions for them if you tell us. If we have to come to the unit to provide this information and/or give out keys, there will be a $75.00 minimum service fee per occurrence. Tenants are not allowed to change the lockbox combination once it has been assigned to them, and any such action will result in a charge of $150 for removal and replacement of the lockbox and enclosed electronic key.
Check Out is 11am. If you prefer a later check out you must contact us in advance and we will do our best to accommodate; however late checkouts may be charged $25.00 per hour and must be out by 1:00pm unless otherwise approved. Upon Check Out All doors and windows must be closed and locked and keys returned to the unit lockbox. There is a $50 dollar fee if keys are not returned. Leave Air Conditioning On and Set to 70 degrees Fahrenheit. Lost or forgotten items are the responsibility of the tenant. The owners assume no responsibility for the same; however, we will assist tenant in the recovery and return of the items.
Occupancy Limits: The maximum overnight occupancy is 8 persons. This includes adults and children of any age. If the guest exceeds the occupancy level, the guest will be evicted. There is a $20.00 per person, per day fee for all unauthorized occupants exceeding the maximum occupancy limit. If evicted, there will be no refunds for unused rent.
Pets are not permitted. Exceptions can be made with written pre authorization for service animals and pet deposit. If evidence of an Unauthorized pet is discovered, we will request that you board your pet or be evicted without refund or recourse. You will be billed a MINIMUM of a $200.00 pet cleaning fee (for professionally cleaning all carpets and upholstery) plus any cost to repair pet damage. You ma also be charged for the cost of loss of rental income, if applicable.
Smoking is prohibited inside the home. If evidence of cigarette smoke is discovered in the home, your group will be evicted without refund or recourse and you will be billed $200.00 + Repair Cost + Cost of Loss of Rental Income.
There may be times it will be necessary for staff or agents of our property property manager, to enter the premises in order to perform routine maintenance or repairs.
5. Cancellation Policy Cancellations must be by phone or in writing sent registered mail (not an answering machine.) and are subject to the following penalties:
Cancellation 4 weeks or more before arrival date is subject to a cancellation charge equal to the deposit paid. If the home is rented out again for the canceled period, the paid deposit will be returned, less US $50 administration charges.
Cancellations less than 4 weeks before arrival date, is subject to a penalty of 100% of the rental amount. If the home will be rented out again for the canceled period, the paid amounts will be returned, less US $50 administration charges. The owner, at their discretion, may offer to apply any unused portion of a reservation, in the form of a credit, to a future reservation.
Refunds are issued as follows:
If payment is made with Paypal, refund will be within 7 days of cancellation.
If payment is made with a personal check drawn on a US bank, refund will be within 14 days.
For payments drawn on banks outside of the US and for bank drafts, refunds will be within 30 days (due to potential fraud issues)
If, through circumstances beyond our control, it is necessary for us to cancel (a condition which would be exceptional) then we will refund the initial booking fee and any other monies paid, without interest or further compensation. We accept no responsibility whatsoever, and no payment or other compensation will be payable, if cancellation or changes to the terms of booking are brought about, or become necessary, due to war or threat of war, riot, civil commotion, terrorist act, industrial dispute, natural disaster, fire, flood or adverse weather conditions or nuclear incident. In addition, we will, not be responsible for closure or congestion of airports, technical problems with transportation or cancellation or schedule changes by carriers whether scheduled or charter. Please be sure to check ahead of time that passports, visas and other documents are in order. Due to some unforeseen circumstance that might arise; such as but not limited to the home becoming uninhabitable, the owner reserves the right to a move reservation to another comparable home or refund all monies paid. The owner will notify you as soon as practically possible about any changes. The owner is not responsible for damages of any sort incurred by tenant as a result of changes in reservation. There shall be no refunds of rents due to shortened stays or ruined expectations because of weather conditions.
6. Cleaning
The home will be cleaned before your arrival and upon your departure. Stays of 7 nights or longer include a one time cleaning fee to occur after departure.
For stays of less than 7 nightss, the cleaning standard charge of $65.00 is added to your rental amount.
It is expected that you will leave the property in a reasonably clean and orderly condition.
Excessive dirt or work for the cleaning team will result in additional cleaning charges to be deducted from the security deposit.
The housekeepers will clean the entire home except for dishes. If dirty dishes are left or found (excluding dishes that have been rinsed and left in the dishwasher) we will AUTOMATICALLY deduct a minimum of $40.00 from your security deposit.
The Tenants shall dispose of all waste material generated during the rental period in a lawful manner and put the trash in the community dumpster during their stay. No trash is to be left in the townhouse after your departure. Tenant is cautioned not to leave trash inside for long periods of time because it attracts insects.
If you would like additional maid service during your stay, contact the local representative 24 hours in advance to arrange additional cleanings at your own expense. You are still expected to carry out reasonable care, and treat the property carefully and with respect.
7. Supplies
Each home is provided with bed linens and several sets of towels, an initial supply of toilet paper, paper towels, dish soap, hand soap, and trash bags. Laundry detergent, dishwasher detergent, laundry soap, shampoos, napkins, and other consumables are not provided.
No reimbursement will be made for unused consumables or items left at the premises. If consumables exist at the premises when you arrive, you are free to use them.
8. Safety and Liability
We the homeowners or our agents do not accept any liability or responsibility for any injury caused as a result of the use of our property or resort facilities. It is the responsibility of an adult member of the party to ensure that children are always properly supervised, especially when in the community recreational areas. Children ARE NOT permitted in the pool or pool area unattended. Posted rules must be adhered to. Occupancy of the homes and use of community walkways, pools and other common areas shall be sufficiently quiet and peaceful so as not to disturb other residents. Please be considerate of all neighbors. Do not allow children to run and jump in the house, or other nuisances as described in the “Rules and Regulations of the Seven Dwarfs Condominium Association”, which have been provided to you.
Tenant agrees that the landlord or agent is not responsible for any injury to any person occurring on the property during the term of occupancy of the tenant.
The Tenants and Tenants' Guests shall hereby indemnify and hold harmless the Owner against any and all claims of personal injury or property damage or loss arising from use of the premises regardless of the nature of the accident, injury or loss.
Any dispute or claim between you, any member of your household, or any of your guests or any user of the townhouse during your stay and us arising out of or relating to use of the townhouse (including all utilities and devices within) during your stay will be resolved by arbitration before a single arbitrator in accordance with the American Arbitration Association's Supplementary Procedures for Consumer-Related Disputes, as modified by this Agreement. The arbitration will take place in Mercer County, New Jersey. The arbitrator's decision will follow the plain meaning of the relevant documents, and will be final and binding. Without limiting the foregoing, you and we agree that no arbitrator has the authority to: (i) award relief in excess of what this Agreement provides; or (ii) award punitive or exemplary damages. Judgment on the award rendered by the arbitrator may be entered in any New Jersey court having jurisdiction. REGARDLESS OF ANY STATUTE OR LAW TO THE CONTRARY, ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE SERVICE MUST BE FILED WITHIN ONE (1) YEAR AFTER SUCH CLAIM OR CAUSE OF ACTION AROSE OR BE FOREVER BARRED. All claims shall be arbitrated individually. You agree not to bring or join any class action of any kind in court or in arbitration or seek to consolidate or bring previously consolidated claims in arbitration.
THIS ARBITRATION PROVISION CONSTITUTES A WAIVER OF ANY RIGHT TO A JURY TRIAL AND AN AGREEMENT TO BE SUBJECT TO JURISDICTION IN NEW JERSEY AND TO CONDUCT ARBITRATION PROCEEDINGS THERE
9. Insurances
We strongly recommend that you purchase appropriate insurance to cover all aspects of your trip.
Although most hospitals must treat emergencies, thereafter medical care can be extremely expensive, and we urge you to ensure that all members of your party have appropriate insurance. Keeping valuables in the house is at your own risk, we the homeowners or our agents do not accept responsibility for any loss of personal items while staying in the property or after departure.
For additional protection, we recommend that you purchase Trip Cancellation Insurance. Most people are not aware that this insurance is available for your vacation rental trip thru companies such as InsureMyTrip.com
There are many different types of trip insurance available, but Trip Cancellation and Interruption protection is the most important benefit you should look for. If your trip has to be cancelled for covered reasons such as illness, accident, death of a family member or traveling companion, jury duty, weather conditions which cause delay/ cancellation of travel or fire or flood in your home, this coverage protects your investment and will reimburse the normally non-refundable payments you make for your vacation rental, airline tickets and other covered travel related fees.
If you miss your planned departure for a covered reason, you may also be covered for additional travel expenses to reach your destination. If you have to interrupt a trip due to a covered illness, this insurance will cover your transportation home. Please see InsureMyTrip.com for details on this coverage.

Note: Coverage varies with different insurance companies - please review your policy details and know what is and is not covered for your policy. Please make sure you understand the policy before you rent.
10. Complaint or Dissatisfaction
In the unlikely event of a problem arising, it should be discussed with our local representative first. We will attempt to resolve any dispute immediately. We will not be held liable for the actions of any third party or public utility, or their inability to provide services, or any other service provider, over whom we do not exercise direct control. We will also not be held liable for any problems arising from or brought about, or become necessary, due to war or threat of war, riot, civil commotion, terrorist act, industrial dispute, natural disaster, fire, flood or adverse weather conditions or nuclear incident.
11. Access
Once the full balance and security deposit have been paid, you will be issued directions to the Villas at Seven Dwarfs Lane vacation home. A confirmation email will be sent to you and should be presented to the guard at the gated entrance of the community. Please feel free to contact our local representative in Florida if you need assistance with with any issues or concerns with the townhouse during your stay.
Park in designated areas only in accordance with all rules in the attached Rules and Regulations of the Seven Dwarfs Condominium Association.
12. Resort Amenities
The use of the various resort amenities cannot be guaranteed as part of the rental. This is dependant on many factors, including maintenance and/or refurbishment, general weather conditions, and occupancy limits. In severe conditions, you may not be able to use resort amenities at all. We cannot, therefore, guarantee their availability. Fishing, tennis, basketball, volleyball, and swimming are complimentary during your stay in the resort community. You may use your own sports equipment at no charge, or equipment for these activities can be rented during business hours at the clubhouse. For the continued enjoyment of the property by guest we do require all guests to abide by the community Rules and Regulations (included with this document.) If a tenant or their guest misuse or abuse the facilities they may lose their privileges to the amenities or be evicted immediately without refund or recourse and charged for any damages and repairs. Cable TV is provided and service level has been chosen by the Landlord. No refund of rents shall be given for outages, content, lack of content, or personal preferences with regard to cable TV service.
